February 2026 HIPAA Notice of Privacy Practices Update

Dental Intelligence Security and Compliance teams are aware of the new HIPAA regulations and Dental Intelligence default forms will be updated to reflect these changes prior to the February 16th deadline.

If you are utilizing customized forms or are unsure if you are utilizing custom forms, please read on below to ensure your patient forms remain compliant.

Update Details

  • Default Forms: Dental Intelligence default form templates will be updated within the software before the February 16, 2026 deadline to include the newly required federal language.

  • Custom Forms: If your practice uses custom-made forms, please note that these will not be automatically updated. You will need to review and revise any custom templates to ensure they reflect the current regulatory requirements.

What do I need to do to make sure my forms are compliant with the updated HIPAA regulations?

Depending on if you're utilizing Dental Intelligence default forms or if you're using customized forms, this will determine your next steps:

I'm using Dental Intelligence default forms.

Great! No action is needed. Forms will be updated to include the newly required federal language by the February 16, 2026 deadline.

I'm using customized forms.

Customized forms will not be automatically updated. Review and revise any custom templates to ensure they reflect the current regulatory requirements.

I'm not sure if my forms are the default version or a customized version.

It's important to review all of your form templates and revise any custom forms to ensure they reflect the current regulatory requirements.

42 CFR Part 2 Updates

While Dental Intelligence provides the platform to assist you with managing your practice, each practice is responsible for its own regulatory adherence. Below is a high-level overview of what the new rule generally requires of dental practices:

  • Update Your Notice of Privacy Practices (NPP): The NPP must be revised to include specific language regarding SUD records, including the patient's right to request restrictions on disclosures.

  • Revised Consent Language: While not mandatory, the update allows for a "single consent" for all future disclosures for treatment, payment, and operations (TPO). Multiple consents are still allowed under this new change. If you use custom consent forms, you may need to update them to reflect the updates.

  • Redisclosure Notices: Disclosures including SUD related information, must be accompanied by a specific statement prohibiting the use of those records in legal proceedings against the patient without a court order.
